Terms of Service (ToS)

By registering an account, purchasing a service, or using our Free Tier, you agree to be bound by these Terms. If you do not agree, stop using GuppyNodes immediately.

1. Account Eligibility

• You must be at least 13 years of age to use our services (COPPA Compliance).
• You agree to provide accurate billing information. Fake names/addresses may result in termination for fraud prevention.
• One Account Policy: Creating multiple accounts to bypass Free Tier limits (Alt-Accounts) is strictly prohibited. Violators will have all accounts and servers terminated.

2. Payments & Refunds

• 48-Hour Guarantee: We offer full refunds within 48 hours of your first payment if you have a valid technical issue that we cannot fix.
• Exceptions: Refunds are NOT granted for:
  • "Changing your mind."
  • Inability to configure software or plugins (lack of knowledge is not a service defect).
  • Accounts terminated for violating the AUP (Abuse).
• Chargebacks: Strict Zero-Tolerance Policy. If you initiate a chargeback or dispute via PayPal/Stripe, your account will be suspended, all services terminated, and you will be blacklisted.

3. Service Availability (SLA)

We aim for 99.9% uptime. However, "Uptime" excludes:

• Scheduled Maintenance (announced in Discord).
• User error (you crashing your own server).
• Force Majeure (Natural disasters, upstream datacenter failures).

4. Data Loss & Backups

You are responsible for downloading your own backups locally. GuppyNodes is not liable for data loss caused by hardware failure, user error, or termination.

5. Affiliate System

Affiliates earn commission on referrals. Self-referrals (using your own link to buy a server) are prohibited and will result in forfeiture of earnings.

Acceptable Use Policy (AUP)

The following activities are strictly prohibited on all services:

1. Prohibited Content

• Crypto Mining (Bitcoin, Monero, etc.).
• Hosting Malware, Phishing sites, or Booters/Stressers.
• Tor Exit Nodes.
• Illegal Pornography or Copyrighted Material you do not own.

2. Network Abuse

• DDoS Attacks (Inbound or Outbound).
• Port Scanning or IP Spoofing.
• Any activity that degrades the performance of the node for other users.

3. Resource Usage (Fair Use)

• Premium Tier: CPU is "Uncapped" but subject to Fair Use. If your service consistently maxes out CPU cores or Disk I/O for extended periods in a way that negatively impacts neighbors, we may ask you to optimize or upgrade.
• Free Tier: Resources are strictly limited. Bypassing limits (e.g., using plugins to fake player counts or RAM usage) will result in deletion.

4. Free Tier Specifics

• Inactivity: Servers with no activity for 14 days may be deleted to free up space.
• Support: Free servers do not come with guaranteed support. Use our Community Discord.

Privacy Policy

We value your privacy. We are a hosting company, not a data broker.

1. What We Collect

• Identity: Name, Email, Discord ID (for account linking).
• Billing: Address/Country (Required by Tax Laws and Fraud Prevention).
  Note: We DO NOT store credit card numbers. These are handled securely by the Payment Processor.
• Technical: IP Address, Server Logs, Browser User Agent.

2. How We Use It

• To provision your server and provide access to the Panel.
• To prevent fraud (e.g., matching IP location to Billing Country).
• To send legal invoices and password resets.

3. Third Parties

We share minimal data with the following partners to operate:

• Payment Processors: For processing transactions safely.
• Infrastructure Providers: The upstream datacenters where your data resides.

4. Your Rights

You can request to view or delete your personal data by opening a billing ticket. Note that we must keep transaction records for legal/tax purposes for up to 6 years depending on jurisdiction.
